New York Investigations Of The Trump Organization

An investigation in the state of New York, examining the business dealings of the Trump Organization. The investigation is probing possible loan fraud and tax fraud., an attorney with extensive experience in prosecuting white-collar and organized crime as the former head of the criminal division in the Manhattan U.S. attorneyâs office, joined the investigation as a special assistant district attorney on February 2, 2021. Trump’s legal team argued that while he was President, he was not required to respond to subpoenas, which delayed investigations and resulted in court cases such as Trump v. Vance. On May 18, 2021, New York Attorney GeneralLetitia James announced that her office would be pursuing the case “in a criminal capacity”, upgrading from a formerly civil investigation. On October 20, 2021, the district attorney of Westchester County announced a criminal investigation into The Trump Organization. The charges could include Grand Larceny in the first degree, Insurance fraud in the first degree, Criminal Tax Fraud in the first degree, Falsifying business records in the first degree, Scheme to defraud in the first degree, and Enterprise Corruption. On September 21, 2022, James filed a civil lawsuit against Trump, the Trump Organization, and three of Trump’s adult children, alleging fraud and misrepresentation.

How Did E Jean Carroll Respond

Ms Carroll – who was an advice columnist for Elle magazine – said in a statement: “When Donald Trump called me a liar and denied that he had ever met me, he was not speaking on behalf of the United States. I am happy that Judge Kaplan recognised these basic truths.”

Her lawyer Roberta Kaplan said the case would now be pursued in a federal court, adding: “That brutal, personal attack cannot be attributed to the Office of the President.”

Ms Carroll’s legal team has asked the president to provide a DNA sample so they can determine whether his genetic material is on a black Donna Karan dress that she says she was wearing at the time of the alleged assault.

Does New Lawsuit Differs Slightly

Lawsuits Over Congressional Subpoenas

In March 2019, the House Committee on Oversight and Reform opened an investigation into Trump’s finances, and issued a subpoena for ten years of his tax returns. Trump later sued the chairman of the committee, Rep. Elijah Cummings, seeking to quash the subpoena.

In April 2019, Trump sued Deutsche Bank, Capital One, his accounting firm Mazars USA, and House Oversight Committee chairman Elijah Cummings, in an attempt to prevent congressional subpoenas revealing information about Trump’s finances. On May 20, 2019, DC District Court judge Amit Mehta ruled that Mazars must comply with the subpoena. Trump’s attorneys filed notice to appeal to the Court of Appeals for the DC Circuit the next day. On May 22, 2019, judge Edgardo Ramos of the federal District Court in Manhattan rejected the Trump suits against Deutsche Bank and Capital One, ruling the banks must comply with congressional subpoenas.

On February 25, 2021, the House Oversight Committee in the 117th Congress reissued the subpoena to Mazars USA for the same documents it had previously sought.

Controversy Over Tax Returns

In October 2016, The New York Times published some tax documents from 1995. Trump claimed on his tax returns that he lost money, but did not recognize it in the form of canceled debts. Trump might have performed a stock-for-debt swap. This would have allowed Trump to avoid paying income taxes for at least 18 years. An audit of Trump’s tax returns for 2002 through 2008 was “closed administratively by agreement with the I.R.S. without assessment or payment, on a net basis, of any deficiency.” Tax attorneys believe the government may have reduced what Trump was able to claim as a loss without requiring him to pay any additional taxes. It is unknown whether the I.R.S. challenged Trump’s use of the swaps because he has not released his tax returns. Trump’s lawyers advised against Trump using the equity for debt swap, as they believed it to be potentially illegal.

After a protracted legal battle against subpoenas to release his tax returns, including two appeals to the United States Supreme Court, in February 2021 the high court permitted the records to be released to prosecutors and a grand jury.

Rosie O’donnell Calls Donald Trump A ‘child Rapist’

The years-long feud between President Donald Trump and Rosie O’Donnell took a dramatic turn Wednesday when the former talk show host accused Trump of being a “child rapist.”

O’Donnell leveled the accusation at Trump after the president weighed in on NBC’s decision to fire veteran Today show anchor Matt Lauer. Trump appeared to deflect sexual harassment allegations against Lauerwho attended the billionaire’s wedding to Melania Trump in 2005and instead called for a probe of senior NBC executives.

The woman, who went by “Jane Doe,” claimed she was raped by Trump and billionaire Jeffrey Epsteina pedophile convicted of sex offenseswhen she was 13 years old. Donald Trump Sexual Misconduct Allegations

Donald Trump, the president of the United States from 2017 to 2021, has been accused of rape, sexual assault, and sexual harassment, including non-consensual kissing or groping, by at least 25 women since the 1970s. “Immediately following this rape Defendant Trump threatened me that, were I ever to reveal any of the details of Defendant Trump’s sexual and physical abuse of me, my family and I would be physically harmed if not killed,” Jane Doe wrote in the lawsuit, filed in New York.

The lawsuit was dropped in November 2016, just four days before the election, with Jane Doe’s attorneys citing “numerous threats” against her.

The president has also been accused of sexual harassment or assault by at least 16 women.

The writer E. Jean Carroll, who has accused Donald J. Trump of raping her in the 1990s and is suing him for defamation, asked on Thursday that he provide a DNA sample to determine whether his genetic material is on a dress she says she had on at the time of the incident.

The request for the DNA sample was made in a letter sent to President Trumps lawyers via email, a spokeswoman for Roberta A. Kaplan, Ms. Carrolls lawyer, said. Ms. Kaplan asked that the sample be turned over by March 2.

Lawrence S. Rosen, a lawyer representing the president in the defamation suit filed by Ms. Carroll, did not immediately respond to a request for comment.

The Associated Press was the first to report that Ms. Carroll was seeking the DNA sample.

The move comes amid a trial in the United States Senate that will determine whether Mr. Trump, who was impeached by the House, will be convicted and removed from office.

What Does E Jean Carroll Allege

She says the attack happened at a Bergdorf Goodman store in Midtown Manhattan in late 1995 or early 1996, when the pair bumped into each other while shopping.

The former Apprentice star and real estate magnate allegedly asked her for advice when buying lingerie for another woman and jokingly asked her to model it for him.

In the changing rooms, she said Mr Trump lunged at her, pinned her against a wall and forced himself on her.

A New York judge has rejected President Trumps bid to temporarily halt proceedings in a lawsuit filed against him by the writer E. Jean Carroll, who has accused him of rape, a ruling that allows the case to move forward in the months before the presidential election.

The decision was a victory for Ms. Carroll, who sued Mr. Trump last November for defamation after he called her a liar and said he had never met her. She that accused Mr. Trump of attacking her in a department store dressing room in Manhattan in the 1990s.

Lawyers for Mr. Trump had sought to put the lawsuit on hold while an appeals court is deciding whether to dismiss a similar lawsuit filed against Mr. Trump by Summer Zervos, a former contestant on The Apprentice who has accused him of sexually assaulting her.

In their bid for a delay, the lawyers also said the Constitution gave a sitting president immunity against civil lawsuits in state court.

Construction And Property Law Matters

In 2011, Donald Trump sued Scotland, alleging that it built the Aberdeen Bay Wind Farm after assuring him it would not be built. He had recently built a golf course there and planned to build an adjacent hotel. Trump lost his suit, with the Supreme Court of the United Kingdom unanimously ruling in favor of the Scottish government in 2015.

In 2013, 87-year-old Jacqueline Goldberg unsuccessfully sued Trump on allegations that he cheated her in a condominium sale by bait-and-switch when she was purchasing properties at the Trump International Hotel and Tower.

In 2015, Trump initiated a $100 million lawsuit against Palm Beach County claiming that officials, in a “deliberate and malicious” act, pressured the FAA to direct air traffic to the Palm Beach International Airport over his estate, because he said the airplanes damaged the building and disrupted its ambiance. Trump had previously sued the county twice over airport noise the first lawsuit, in 1995, ended with an agreement between Trump and the county Trump’s second lawsuit, in 2010, was dismissed.

Donald Trump Wins Ruling In Rape Accuser Carrolls Defamation Lawsuit

A federal appeals court set aside a judges ruling that Donald Trump could be sued for defamation by E. Jean Carroll after denying he raped her, though it stopped short of declaring the former U.S. president immune from the authors lawsuit.

In a 2-1 decision on Tuesday, the 2nd U.S. Circuit Court of Appeals in Manhattan asked an appeals court in Washington to weigh in on whether the laws of that district shielded Mr. Trump from liability.

But the Manhattan court also accepted Mr. Trumps argument that he qualified as a U.S. government employee when he allegedly defamed Ms. Carroll, a condition underlying his immunity claim.

A dissenting judge, Denny Chin, would have let Ms. Carroll pursue at least some claims, saying Carrolls allegations plausibly paint a picture of a man pursuing a personal vendetta against an accuser.

Ms. Carroll sued Mr. Trump in November, 2019, and had been hoping to go to trial as soon as next February.

She had accused Mr. Trump in a June, 2019, book excerpt of having raped her in late 1995 or early 1996 in a dressing room at the Bergdorf Goodman department store in midtown Manhattan.

Roberta Kaplan, a lawyer for Ms. Carroll, said in a statement she was confident the District of Columbia court would let the case proceed.
