Case Summary: In 2019, Carroll publicly accused then-President Trump of sexually assaulting her in a New York City department store in the 1990s. A few hours later, Trump denied Carrolls allegation and accused her of fabricating the story to drum up publicity for her upcoming book. Carroll then sued Trump for defamation in New York state court, alleging that Trump defamed her when he publicly accused her of falsifying the assault story.

After nearly a year of state court proceedingsand with Carrolls counsel angling to sample Trumps DNAthe Justice Department moved to intervene on Trumps behalf under the Federal Tort Claims Act . This move threatened to quash the suit. In effect, the FTCA provides blanket immunity to federal employees who commit certain tortsincluding defamationarising out of their official duties. According to the DOJ, the presidents official duties include speaking to the press about public matterswhich would mean that Trump had immunity from any defamatory statements he made about Carroll.

Case Status: In the SDNY proceedings, the parties filed opposing memoranda on Trumps motion to stay in December 2020.

Update: Carroll filed her brief on Apr. 16, 2021, urging the appeals court to uphold the decision below.

Donald Trumps Odds Of Going To Prison Just Skyrocketed

Three years after it began its criminal investigation of Donald Trumps Trump Organization and its executives, the Manhattan District Attorneys Office is reportedly expected to charge the ex-presidents company and its chief financial officer, Allen Weisselberg, with tax-related crimes on Thursday, according TheWall Street Journal. Obviously this marks a major escalation of the probe, and Trump will presumably respond to the news by lashing out like a man increasingly concerned that prison may be in his future.

According to the Journal, Weisselberg and the company are expected to be hit with charges related to allegedly avoiding paying taxes on fringe benefits. For months Cyrus Vance Jr.s office has been investigating whether the perks the CFO was awarded, including cars, corporate apartments, and private school tuition, were a way of evading money owed to the IRS. In addition to reportedly obtaining Weisselbergs personal tax returns, the D.A.s office scored a trove of financial documents from his ex-daughter-in-law, Jennifer Weisselberg, whose former husband, Barry Weisselberg, is also a longtime employee of the company.

Meanwhile, per the Journal:

As Weisselbergs ex-daughter-in-law told Air Mail in April, Trump doesnt care about Allen, but Allen knows every bad thing he ever did.

Case Summary: DC Attorney General Karl Racine has said he is exploring whether to charge Trump with incitement. So far, his office has focused on a DC statute that makes it a misdemeanor to incite or provoke violence where there is a likelihood that such violence will ensue. Presumably, DC prosecutors are looking into Trumps statements and tweets before and during the riot, gauging whether they amount to criminal incitement.

That said, Racine has cautioned that prosecuting Trump would be an uphill battle. Though the former president no longer could claim presidential immunity, the First Amendment may still shield his speech from prosecution. Under Brandenburgthe controlling case herea speaker can be prosecuted for incitement only when their speech is both intended and likely to cause imminent lawless action. This is a notoriously difficult standard to meet, especially on the intent side. Even though some rioters haveclaimed they were following Trumps instructions, Racine would need to actually prove it was Trumps actual goal for them to do so. Despite the trailofincriminatingstatements Trump left behind, Racine may still have trouble meeting such a high bar.

The not guilty verdicts in the Kyle Rittenhouse trial triggered reactions across the political spectrum Friday, reflecting polarized views around a case arising from the aftermath of the police shooting of Jacob Blake.

Rittenhouse’s supporters saw a just verdict for a 17-year-old defending himself while defending private property in the chaos that followed the Blake shooting. For others it was a mockery of justice a free pass for a vigilante taking the lives of unarmed protesters.

President Joe Biden and Gov. Tony Evers offered measured responses.

I stand by what the jury has concluded,” Biden told reporters. “The jury system works and we have to abide by it.

In a later statement, the president said he had been in contact with the governor about possibly outcomes of the verdict.

“I urge everyone to express their views peacefully, consistent with the rule of law. Violence and destruction of property have no place in our democracy,” he said. “The White House and Federal authorities have been in contact with Governor Evers’s office to prepare for any outcome in this case, and I have spoken with the Governor this afternoon and offered support and any assistance needed to ensure public safety.”

Vice President Kamala Harris said in an interview with the Columbus Dispatch that she was “disappointed” with the verdict.

Gov. Tony Evers called for peaceful protests in the wake of the verdict, but acknowledged the pain and hurt being felt throughout the state.

Capitol Police Suit For Jan 6 Riots

Case Summary: On Mar. 30, 2021, two Capitol Police Officers sued Donald Trump for injuries they sustained during the Jan. 6 riots in DC. The officersJames Blassingame and Sidney Hembysay they were maced with bear spray, attacked with fists and flagpoles, and even crushed against a door as they tried to protect the Capitol from pro-Trump intruders.

Much like the other Jan. 6 suits against Trump, the officers pin their injuries on Trumps incendiary rhetoric before and during violence. Both allege that Trump directed the rioters to assault them, aided the rioters in committing those assaults, and negligently incited the riot in violation of DCs public safety codes. Blassingame also accuses Trump of directing intentional infliction of emotional distress, pointing to the racial slurs and taunts that the intruders allegedly hurled at him during the violence.

Case Status: The officers filed their suit in DC federal court on Mar. 30, 2021. On Apr. 28, 2021, the plaintiffs added two new conspiracy claims against Trump, one based on the KKK Act and the other on common law conspiracy. They allege that Trump illegally conspired with the Proud Boys and the Oath Keepers to storm the Capitol, which in turn caused the plaintiffs injuries.

    Donald Trump has been made an honorary black belt by the South Korean president of taekwondo – despite never having practised the sport.

    The former president was handed the honorary rank by president Lee Dong-sup at his home in Mar-a-largo, Florida.

    He was given an honorary ninth dan certificate – the highest level in the sport.

    The sporting body wrote on its Facebook page that Mr Trump said upon receiving the award: “It is my honor to receive Honorary Dan Certificate and I think Taekwondo is magnificent martial art for self-defense.

    “I wish to see Kukkiwon Taekwondo Team’s demonstration.”

    The organisation added that the ceremony was “not related to any other political issues”.

    The award means he now has the same rank as Russian President Vladimir Putin, who was made an honorary ninth dan in 2013. President Putin had also not practised taekwondo at the time of the award.
