NEW YORK New York Attorney General Letitia James today took legal action to compel Donald J. Trump, Donald Trump, Jr., and Ivanka Trump to appear for sworn testimony as part of the offices ongoing civil investigation into the Trump Organizations financial dealings. The motion to compel filed today seeks a court order enforcing testimonial subpoenas issued to Donald J. Trump, Donald Trump, Jr., and Ivanka Trump, as well as the production of documents held by Donald J. Trump. As the papers filed today make clear, each of the individuals was directly involved in one or more transactions under review. Earlier this month, the Trumps filed a motion to quash these interviews, and the papers filed today by the Attorney General oppose that motion.

Background

As detailed in todays filings, Attorney General James opened an investigation into Donald J. Trump and the Trump Organization in March 2019, after Trumps former lawyer, Michael Cohen, testified before Congress that Trumps annual financial statements inflated the values of Trumps assets to obtain favorable terms for loans and insurance coverage, while also deflating the value of other assets to reduce real estate taxes.

Promotion Of Conspiracy Theories

Trump Jr. retweeted conspiratorial remarks by white supremacist Kevin B. MacDonald about alleged favors exchanged by Hillary Clinton and Switzerlandâs largest bank. On the campaign trail, Trump Jr. promoted Alex Jonesâ conspiracy theory that Hillary Clinton wore an earpiece to a presidential forum and that official unemployment rates were manipulated for political purposes.

In March 2017, Trump Jr. criticized the mayor of London, Sadiq Khan, after the 2017 Westminster attack, which in turn led British lawmakers to criticize Trump Jr. British journalists said Trump Jr. had quoted Khan out of context when he criticized him. Khan did not respond to the criticism, saying he had âfar more important thingsâ to do.

In May 2017, Trump Jr. promoted what CNN called the âlong-debunked, far-right conspiracy theoryâ that Bill Clinton was linked to Vince Fosterâs death. In November, Trump Jr. again promoted the conspiracy theory that the Clintons had murdered people.

In February 2018, Trump Jr. liked two tweets promoting a conspiracy theory that survivors of the Stoneman Douglas High School shooting were coached into propagating anti-Trump rhetoric.

In June 2018, Trump Jr. liked a tweet suggesting that the migrant children separated from their parents due to the Trump administration family separation policy were actually actors.

In May 2020, Trump Jr. falsely accused Joe Biden of being a pedophile.

Don Jr. came under fire for tweeting and deleting a racist message from a right-wing personality after the first Democratic primary debate.     Twitter flagged Trump Jr.s tweet just as it has been doing with other questionable posts by him, his father and other Trump supporters.

    Trump and his people are furious about that, calling it censorship.

    It is not.

    Its the responsible thing to do. But people in the Trump-sphere keep posting because the media, myself included, will amplify it.

    Good for Twitter for flagging calls for violence. But it isnt enough. All of us must be vigilant and call it out.

    What’s the use of the hearings by the House committee to investigate the January 6 insurrectionhearings that began last night and will run for the next several weeksunless they lead to criminal prosecution of Donald Trump for his patently criminal actions?

    In a word: History. We tend to underestimate the importance of an historic record. But it is vastly important. It charts the course of the future by illuminating the course of the past. It is literally the final word.

    I don’t know whether Trump will be prosecuted. He deserves to be. He has violated his oath to the Constitution he has violated America. But even if he is not prosecuted, the hearings will provide a full, detailed account of what Trump did in the weeks and months after the 2020 electionand therefore of what he did to our nation.

    In other words, even if he avoids prosecution, even if he is never formally deemed a criminal under the law, Trump will be accountable to history. That is not as satisfying a form of accountability as a criminal judgment, to be sure. But it is a form of accountability that is inescapable. If the committee does its work properlyand I have every confidence it willit will create a clear record. Which means that for our children and our children’s childrenfor as far as future generations will know of our recorded historyDonald Trump will live in infamy.
