Setting His Sights On The Inauguration Biden Says Impeachment Is Up To Congress

With Washington in turmoil and lawmakers threatening President Trump with impeachment, President-elect Joseph R. Biden Jr. put his focus on Friday on Inauguration Day and the chance to press ahead with his agenda, sidestepping the question of whether Mr. Trump should once again be impeached.

Mr. Biden declared that it was a good thing that Mr. Trump had decided not to attend the inauguration on Jan. 20 and said the president had exceeded even my worst notions about him. But Mr. Biden deferred to Congress on whether Mr. Trump should be impeached over his role in inciting the violent mob that stormed the Capitol on Wednesday.

What the Congress decides to do is for them to decide, Mr. Biden said.

I think its important we get on with the business of getting him out of office, he added. The quickest way that that will happen is us being sworn in on the 20th. What action happens before or after that is a judgment for the Congress to make, but thats what I am looking forward to, him leaving office.

With the pandemics death toll continuing to grow, Mr. Biden spoke with urgency about the health and economic crises facing the country, and his plans to take action upon assuming office. And even after the mayhem on Capitol Hill and efforts by some Republicans to object to his election victory, the president-elect continued to sound hopeful about working with both parties and bringing the country together.

WASHINGTON The Republican National Committee is defending its right to use former President Donald Trumps name in fundraising appeals after he demanded they put an end to the practice.

In a Monday letter to Trump attorney Alex Cannon, RNC chief counsel J. Justin Riemer said the committee has every right to refer to public figures as it engages in core, First Amendment-protected political speech and said it will continue to do so in pursuit of these common goals.

But he maintained that Trump had also reaffirmed to the chair of the RNC, Ronna McDaniel, over the weekend that he approves of the RNCs current use of his name in fundraising and other materials, including for our upcoming donor retreat event at Palm Beach at which we look forward to him participating.

Trump responded to the letter with a statement that put that agreement in doubt. No more money for RINOS, or Republican in name only, he stated. They do nothing but hurt the Republican Party and our great voting base they will never lead us to Greatness. He instead again urged his supporters to send their contributions directly to his own Save America PAC by using his personal website, adding, We will bring it all back stronger than ever before!

Despite the letters, the RNC and others have continued to fundraise off of Trumps name.

Devos Pushes Back At Critics Who Said She Resigned To Dodge A Decision On The 25th Amendment

Education Secretary Betsy DeVos, one of several Trump administration officials who have announced their resignations in the aftermath of Wednesdays assault on the Capitol, is pushing back against critics who claimed she was resigning to dodge the decision of whether to support President Trumps removal under the 25th amendment.

Ms. DeVos had been accused by Democrats and other longtime critics of attempting to skirt her responsibility to hold the president accountable.

Betsy DeVos has never done her job to help Americas students, wrote Senator Elizabeth Warren, Democrat of Massachusets, in a tweet Thursday. It doesnt surprise me one bit that shed rather quit than do her job to help invoke the 25th Amendment. Good riddance, Betsy. You were the worst Secretary of Education ever.

But advisers familiar with her decision said Ms. DeVos submitted her resignation to Mr. Trump on Thursday, after it became clear that Vice President Mike Pence would not invoke the 25th Amendment. And on Friday morning, her last day, Ms. DeVos replied to Ms. Warren saying, You know not of what you speak.

After the decision by Mr. Pence, a close friend and ally, Ms. DeVos felt the strongest measure she could take to uphold her oath to the Constitution was to submit her resignation, according to a senior administration officials.

A United States Capitol Police officer died Thursday night from injuries sustained when he engaged with a pro-Trump mob that descended on the U.S. Capitol the day before.

Officer Brian D. Sicknick died at about 9:30 p.m. on Thursday, the Capitol Police said in a statement. He had been with the agency since 2008.

Mr. Sicknick was responding to the riots on Wednesday and was injured while physically engaging with protesters, the agencys statement said, although officials didnt immediately elaborate on the nature of his injuries or how he interacted with the crowd. After sustaining the injuries, Mr. Sicknick returned to his division office, collapsed, and was taken to the hospital.

The entire U.S.C.P. department expresses its deepest sympathies to Officer Sicknicks family and friends on their loss, and mourns the loss of a friend and colleague, the statement said. News outlets had prematurely reported on his death earlier in the day while he was apparently still on life support.

Officer Sicknicks death brings the death toll from Wednesdays mayhem to five. One of the people participating in the pro-Trump rampage, Ashli Babbitt, was shot and killed by a Capitol Police officer inside the building as she climbed through a broken window leading to the Speakers Lobby. Three other people died, the police said, after experiencing apparent medical emergencies in the area around the Capitol.

The Man Who Stormed Pelosis Office And A West Virginia Lawmaker Are Among Those Arrested

A lawmaker from West Virginia and a man who broke into Speaker Nancy Pelosis office and posed at a desk there were among those arrested on charges related to the siege at the Capitol, federal law enforcement officials announced on Friday as they promised an exhaustive investigation into the violence.

The authorities also found 11 Molotov cocktails and a semiautomatic rifle in the truck of a 70-year-old man from Alabama who was also arrested, according to prosecutors. He also had two handguns.

Hundreds of prosecutors and F.B.I. agents have been assigned to work the investigation and were pursuing dozens of cases, Ken Kohl, a prosecutor in the U.S. attorneys office in Washington, said in a briefing with reporters.

We are far from done, added Steven M. DAntuono, who runs the F.B.I.s Washington field office.

Federal law enforcement officials have charged at least 13 people, the Justice Department said in a news release later Friday, several on charges of unlawful entry. Washington police have also arrested dozens, mostly on charges of unlawful entry and curfew violations. The United States Capitol Police announced the arrests of 14 other people on Thursday.

Among those charged was Derrick Evans, a newly elected lawmaker from West Virginia, Mr. Kohl said. Mr. Evans posted video to his Facebook page of him filming as he stood among the crowd outside a Capitol door and then rushing inside with them.

WASHINGTON The White House on Friday formally blocked an attempt by former President Donald Trump to withhold documents from Congress related to the , setting up a legal showdown between the current and former presidents over executive privilege.

In a letter to the National Archives obtained by NBC News, White House Counsel Dana Remus rejected an attempt by Trumps attorneys to withhold documents requested by the House Select Committee regarding the then-presidents activities on Jan. 6, writing that President Biden has determined that an assertion of executive privilege is not in the best interests of the United States, and therefore is not justified as to any of the documents.

These are unique and extraordinary circumstances, Remus added. Congress is examining an assault on our Constitution and democratic institutions provoked and fanned by those sworn to protect them, and the conduct under investigation extends far beyond typical deliberations concerning the proper discharge of the Presidents constitutional responsibilities. The constitutional protections of executive privilege should not be used to shield, from Congress or the public, information that reflects a clear and apparent effort to subvert the Constitution itself.

Remus says in her letter that the White House is continuing to review other materials the archives have provided since then, and will respond at an appropriate time.

The threat to impeach President Trump in his final days in office raises political, constitutional and logistical questions rarely contemplated in American history: No president has ever been impeached twice or after already losing re-election.

Here are four key things to know:

There is nothing preventing a second impeachment.

The House impeached Mr. Trump in December 2019 on charges of abuse of power and obstruction of Congress related to his attempts to pressure Ukraine to smear Joseph R. Biden Jr., and the Senate acquitted him.

No American president has ever been impeached twice. But there appears to be nothing in the Constitution stopping Congress from impeaching again on a new set of charges.

The timing is tight, but not impossible.

Past presidential impeachments have typically been drawn-out affairs with investigations, hearings and weeks of public debate, but that is not required.

If Democrats and some Republicans are in agreement, they can bypass the House Judiciary Committee and move in a matter of days to draw up charges and proceed directly to a debate and vote on the floor of the House. Then, if the House votes to adopt articles of impeachment, they can immediately transmit them to the Senate, which must promptly begin a trial.

The impeachment process could continue after Mr. Trump leaves office.

The Senate could vote to bar Mr. Trump from ever holding office again.
