Kyle Rittenhouse could argue President Joe Biden defamed him with a tweet apparently linking him with white supremacists, according to a lawyer who won a defamation case for the student Nicholas Sandmann.

Todd McMurtry helped Sandmann, a former Kentucky high school student, reach a settlement with CNN after he was portrayed as the aggressor in an apparent confrontation in January 2019 with a Native American activist on the National Mall in Washington, DC.

A longer version of the video debunked media reports that Sandmann, a student at Covington Catholic High School, was the aggressor but not before a number of media outlets portrayed the incident as being racially charged.

McMurtry told Fox News that Biden could be accountable for his tweet on the presidential campaign trail on September 30, 2020, in which he said then-President Donald Trump had “refused to disavow white supremacists on the debate stage.”

Biden’s message was accompanied by a video clip in which Rittenhouse is pictured holding a weapon.

On Friday, Rittenhouse was acquitted of all charges related to the fatal shooting of two men during protests in Kenosha, Wisconsin, on August 25, 2020.

“What you take from that tweet is that Kyle Rittenhouse was using his rifle and engaging in white supremacist misconduct,” McMurtry told Fox News, “so it’s actionable. Not necessarily going to win, but it’s actionable.”

President Trump has a penchant for tagging his political opponents with simple, but biting nicknames. The one he chose for his presumptive Democratic presidential challenger, former Vice President Joe Biden, doesn’t seem to have landed like those in the past, however, Axios reports.

It’s well-known Trump refers to Biden as “sleepy Joe,” but so far, at least judging by Google search trends, voters apparently don’t associate the moniker with Biden all that much. Trump dubbed his 2016 opponent, Hillary Clinton, as “crooked” Hillary, which prompted far more searches than “sleepy Joe.” As analysts noted, there are likely several reasons for this. Regardless, it could be a small, but telling data point that shows Trump’s patented insults may not have the same affect in 2020 now that the novelty has worn off.

Trump has neither campaigned for Youngkin nor made an endorsement in the race.

But the suddenly tight Virginia contest with Youngkin has become a test of Bidens political strength ahead of next years midterm elections and a possible rematch with Trump in the 2024 presidential race and comes as Bidens approval ratings and polling on core issues have nosedived.

The Virginia race has focused heavily on Biden as the presidents approval ratings drop amid setbacks including high inflation and a supply-chain bottleneck following a chaotic US pullout from Afghanistan, a continued Mexico border crisis and a resurgence of COVID-19 infections caused by the more contagious Delta variant.

The Virginia governors race and close gubernatorial contest in New Jersey, also next week, are seen as a test of support for national Democrats.
