Democratic lawmakers could use the 14th Amendment to keep former president Donald Trump from running for the presidency again in the 2024 election, according to an opinion piece.

Section 3 of the 14th Amendment states that a person is disqualified from being president, vice-president, senator or representative in Congress if they participated in an insurrection or rebellion or aided such acts against the United States while holding federal office.

To use the 14th Amendment, the Democratic Party could file a lawsuit against Trump in federal court, seeking a ruling that Trump participated in the Jan. 6, 2021, Capitol insurrection and an order that would disqualify him from running even as a candidate for the presidency. Trump can then choose to fight the lawsuit or claim the Fifth Amendment privilege against self-incrimination, according to an opinion piece written by Alan B. Morrison and published by The Hill.

Trump was impeached by the House of Representatives in January for a charge of incitement of insurrection after a mob of his supporters stormed the Capitol in the final days of his office. The riot led to the death of five people, including a Capitol police officer.

According to a report that came out on Saturday evening, some of the documents seized by the FBI at Mar-a-Lago were allegedly protected by attorney-client privilege.

Fox News reported, the former presidents team was informed that boxes labeled A-14, A-26, A-43, A-13, A-33, and a set of documentsall seen on the final page of the FBIs property receipt contained information covered by attorney-client privilege.

In the post on Truth Social, the former president wrote that he had just learned about the claims.

It has just been learned that the FBI, in its now famous raid of Mar-a-Lago, took boxes of privileged attorney-client material, and also executive privileged material, which they knowingly should not have taken, Trump wrote. By copy of this TRUTH, I respectfully request that these documents be immediately returned to the location from which they were taken. Thank you!

Andrew McCarthy, the former chief assistant U.S. attorney in the Southern District of New York, said that if he really wants the documents back, he should request them through the court but warned against doing so.

The sources who spoke to Fox explained that the Justice Department also opposed Trump lawyers request for the appointment of an independent, special master to review the records.

According to the receipt, the feds took about 20 boxes of documents from Trumps residence.

The Claim: An Image Shows A Fundraising Email From Donald Trump With Nuclear Codes

After the FBI searched former President Donald Trump’s Mar-a-Lago estate on Aug. 8, the Washington Post that said the agents were looking for classified documents related to nuclear weapons, among other items.

Following this report, some social media users shared screenshots of an email Trump supposedly sent a day after the search with nuclear codes.

A Facebook post shows a screenshot of a with that purported fundraising email. It includes the subject line “MAR-A-LAGO: RAIDED,” a red banner with Trump’s face and text that says, “The nuke codes are 15-25-50-80,” followed by a request to donate $15, $25, $50 or $80.

“NEW: Donald is fundraising by giving us ‘nuclear codes,'” the tweet says.

Text above the tweet in the Facebook post reads, “Do Trump and Republicans believe it is appropriate to use jokes about stolen #nucleardocuments to fundraise?”

The post, along with several in the samevein, garnered a few dozen shares, and the original tweet amassed over 13,000 likes since it was published Aug. 11.

But the email shown here is digitally altered.

The original fundraising email sent after the Mar-a-Lago search, which USA TODAY obtained from Trump’s spokesperson, contains different body text and does not include nuclear codes.

USA TODAY reached out to the social media users who shared the claim for comment.

Donald Trump Jr, the son of former US president, took to his Instagram account to share some photos of the birthday party. The guests included Donald Jr.s girlfriend Kimberly Guilfoyle, former NFL star Herschel Walker, Indiana congressman Jim Banks and Colorado congresswoman Lauren Boebert.

The most notable absentee was Donald Trump’s wife and former First Lady, Melania Trump.

Ex-wife Ivana Trump once said in an interview that “Donald hates his birthdays”, and a source also told People magazine that Melania “keeps her own schedule and leads her own life” away from her husband.

The absence of Melania has once again sparked the divorce rumors between the couple but writer Kristyn Burtt said that it is wrong to say that Melania has decided to part ways with Donald Trump.

She said: “She did that at the start of his administration when she and son Barron remained in New York City so he could finish out the school year before they moved to Washington, D.C. The couple has very different hobbies and seems to prefer their independent activities, but no one should read too much into her absence. This shouldnt be seen as a sign that there is trouble in their marriage.”

The shocking FBI raid on Mar-a-Lago quickly sparked a heated legal debate as to whether a conviction would disqualify former President Trump from running again for the White House.

As political and legal experts united in calling Mondays raid unprecedented, there was little consensus on whether it could ruin Trumps chances of a 2024 run or even hand him a surefire victory.

Soon after Trump confirmed the raid saying his Florida estate was under siege and occupied by the feds many legal experts pointed to a law they said Trump could be hit with if he was convicted of taking classified presidential records, widely thought to be the potential federal violation the raid was investigating.

He linked to a screenshot of 18 U.S.C. § 2071, which makes it a crime if those with custody of government documents willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies or destroys them.

Anyone convicted faces up to three years in prison and shall forfeit his office and be disqualified from holding any office under the United States.

Donald Trump Flack Says Email Reveals Who Took Passports From Mar

A Donald Trump spokesman is doubling down on the former president’s assertion that federal law enforcement seized his passports after an earlier report stated the Department of Justice said it did not have the sensitive documents.

Taylor Budowich, Trump’s director of communications, on Monday posted to an email apparently from a top DOJ national security official saying that the passports had been seized by “filter agents” and would be returned. The tweet, which targeted CBS News reporting, followed a series of contentious exchanges over the FBI‘s search of Trump’s Mar-a-Lago resort home in Florida.

Budowich’s tweet was in response to CBS News’ Norah O’Donnell tweeting that a DOJ official told the news outlet that “the FBI is NOT in possession of former President Trump’s passports.” The reporting contradicted a post Trump made earlier to his Truth Social network in which he said FBI agents had taken three of his passports, one of which had expired.

“We are also learning tonight that if any items not contained in the warrant were retrieved during the FBI search at Mar-a-Lago, they will be returned,” O’Donnell said in a followup tweet.

Budowich responded Monday with a redacted email from Jay Bratt, head of counterintelligence in the DOJ’s national security division, saying that he learned the passports, two expired, had been seized by “filter agents” and would be ready for pickup later that day.

The purported email is “totally fake,” Liz Harrington, Trump’s spokesperson, told USA TODAY in an email. The original Aug. 9 email sent with the same subject line and red banner contains different accompanying text and has no mention of nuclear codes.

New York Times reporter Shane Goldmacher tweeted an image of the email with the caption “NEW: I believe this is Trump’s first fundraising email off the FBI search.”

The email reads “BREAKING: THE FBI RAIDED PRESIDENT TRUMP’S HOME: MAR-A-LAGO” and begins with the following: “These are dark times for our Nation, as my beautiful home, Mar-a-Lago in Palm Beach, Florida, was raided, and occupied by a large group of FBI agents.”

Trump adds that “nothing like this has ever happened to a president of the United States before,” claiming that the Mar-a-Lago search was a violation of the “home of every patriotic American.”

Trump concludes the email by asking his supporters for donations.
