Turning The Corner On Title Ix

Colleges scrambled to stand up new Title IX policies to meet the requirements laid out in the Ed Department’s new regulations governing sexual misconduct, which were released in May and became effective in August.

The rule narrows the definition of sexual harassment, allows both parties to cross-examine each other through surrogates and blocks colleges from investigating a matter unless an official complaint exists. It also gives the accused the right to an adviser and to see the evidence against them.

Title IX cases have been a minefield for colleges. According to one recent analysis, the number of students suing universities over how they handled their cases has skyrocketed in the last several years. It also found state and federal courts ruled against colleges more than half the time in cases that resulted in “substantive decisions.”

Proponents of the new rule say it protects the due process rights of the accused. Critics say it creates a quasi-judicial system of addressing sexual misconduct on campus and limits colleges’ ability to look into potential sexual violence cases.

However, legal experts have said colleges, already beleaguered by the pandemic, weren’t given enough time to adapt to the new regulations.

Fordham Students Dont Acknowledge That He Went There

In part due to this sense that Trump looked down upon Fordham and was not proud of the school, current students dont really acknowledge that he attended.

Since he matriculated and didnt earn his degree, most of us dont even acknowledge him being at Fordham, Matthew Santucci, editor of the Fordham Political Review, told the New York Daily News. He has distanced himself from Fordham, so he doesnt have a clear connection to the school. We dont even acknowledge that he went here.

In March, Sebastian Balasov, secretary of the Fordham Republicans, said that Trump doesnt really represent values and that its hard to defend him but added that campus republicans would still support Trump in the general election if it came to that. Since that interview, Trump has clinched the GOP nomination.

Trumps Use Of Administrative Power

Like his predecessors, President Donald Trump had the opportunity to use his executive, administrative, and political power to shape education policy. As Frank J. Thompson, Barry G. Rabe, and I document in our new book published by the Brookings Institution PressTrump, the Administrative Presidency, and FederalismTrumps education policy agenda aimed at weakening federal oversight and reversing Obamas commitment on civil and student rights in public schools.

To be sure, Trumps presidency did not pursue major legislation in public education. Trumps lack of legislative accomplishments in education policy can be attributed in part to Congresss enactment of the 2015 Every Student Succeeds Act , the latest in a series of reauthorizations of the Elementary and Secondary Education Act originally passed in 1965. ESSA granted states flexibility when it came to accountability and placed restrictions on federal interference in state education decision-making or set common standards across states. There was little expectation when Trump took the presidential oath in January 2017 that Congress had an interest in revisiting or reopening these issues addressed in the bipartisan ESSA adopted in December 2015. Further, the administration enjoyed mixed success in gaining congressional approval for budgetary requests in education including proposals to repurpose categorical funding for school choice and to downsize the U.S. Department of Education.

More Than 400000 Manufacturing Jobs Created Since His Election

It was true, but since the pandemic, the Trump administration has seen a net loss of about 200,000 manufacturing jobs, wiping out the past six years of growth, according to the Alliance for American Manufacturing. More than 900,000 manufacturing jobs were added between 2010 and 2016 during the Obama administration.

For schools, the pressure campaign is more about politics and the bully pulpit than federal policy. What issues get taught in classrooms are always local decisions, said Arne Duncan, who served as education secretary under Obama.

When it comes to setting curriculums, Trump has no ability to do that. Hes a fraud.

But Trumps line of attack is part of a decades-long thread of conservative activism targeting public schools, said Andrew Hartman, an Illinois State University professor of history who studies culture wars. Conservative parent activists have attacked schools for teaching sex education they regard as immoral, for example, or assigning books they view as too lurid.

This has become a bedrock of the conservative movement since the 70s that the public schools are secular, that the public schools are liberal or even radical and that the public schools are destroying the fabric of America, Hartman said.

Albert Broussard, a professor at Texas A& M who specializes in Afro-American history and has written history textbooks, viewed Trumps comments less as a serious policy proposal and more as an effort to stoke his base. Broussard believes its a backlash against recent efforts to present a more varied narrative of U.S. history.

Trump plays to this idea of White grievance and White fear and White insecurity, Broussard said. The countrys population has changed racially and ethnically … I think that will continue to provoke anxiety among some people.

Federal Funding For School Choice Is Increasing Only Minimally

At the top of the education goals Donald Trump released during his 2016 campaign was a promise to add $20 billion in federal funding to school choice programs.

School choice programs direct public money to public charter schools and private school scholarships. Alternatives to public schools have grown more popular in the past 15 years, with charter school enrollment tripling between 2005 and 2016, and private school voucher programs now including 538,900 students nationwide.

Supporters of school choice programs say they give parents, including those whose children are zoned for poorly performing schools, more free options for their children. Critics of school choice say that the money should be directed instead toward improving local public schools and that some programs provide less transparency than government-run school districts.

Trump’s administration has made small increases in funding for existing federal school choice programs, but it hasn’t gotten any new legislation passed or significantly expanded funding.

Trump and Education Secretary Betsy DeVos have pushed for new federally funded school choice programs, but none of their programs have received enough support to pass in Congress.

The most recent large piece of legislation DeVos introduced was the Education Freedom Scholarships. DeVos announced on Feb 28, 2019, that the new legislation would provide $5 billion in annual tax credits for donors who gave to state-based scholarship programs.

The administrations promotion of school choice options and vision for a limited Education Department carried into policy and budget initiatives.

For a president whose 2016 campaign said very little about K-12 education issues and in fact suggested the elimination of the U.S. Department of Education, Donald Trumps education policies may have lasting impacts on where children are educated, how federal funding is allocated and how education-related civil rights are interpreted and enforced.

Heres a look back at a few of the major K-12 changes under the Trump administration and their significance, according to education experts who have monitored the presidency closely.

Election To The Presidency

On November 8, 2016, Trump received 306 pledged electoral votes versus 232 for Clinton. The official counts were 304 and 227 respectively, after defections on both sides. Trump received nearly 2.9 million fewer popular votes than Clinton, which made him the fifth person to be elected president while losing the popular vote. Clinton was ahead nationwide with 65,853,514 votes to 62,984,828 votes .

Trump’s victory was considered a stunning political upset by most observers, as polls had consistently showed Hillary Clinton with a nationwide though diminishing lead, as well as a favorable advantage in most of the competitive states. Trump’s support had been modestly underestimated throughout his campaign, and many observers blamed errors in polls, partially attributed to pollsters overestimating Clinton’s support among well-educated and nonwhite voters, while underestimating Trump’s support among white working-class voters.The polls were relatively accurate, but media outlets and pundits alike showed overconfidence in a Clinton victory despite a large number of undecided voters and a favorable concentration of Trump’s core constituencies in competitive states.

In September 2020, Trump was nominated for the 2021 Nobel Peace Prize. A far-right Norwegian politician nominated Trump’s name citing his role in the peace deal between Israel and the United Arab Emirates.

Devos Loses Latest Fight Over Rerouting Aid To Private School Students

This fight captures DeVos’ determination to use federal power to legitimize and nurture alternatives to public education, but, as was often the case, her efforts failed. In September, a federal judge determined that the department had not only “acted beyond its authority” but misinterpreted the will of Congress, and DeVos later dropped the fight.

When asked to name DeVos’ lasting achievements, Morabito tops the list with Education Freedom Scholarships, calling the proposed voucher program “the most transformative K-12 policy in our nation’s history.” It would have provided up to $5 billion a year for children to attend the school of their choice, including nonpublic and religious schools. While the bill has more than 120 co-sponsors in Congress, it doesn’t have the kind of broad support it needs to pass. And so this “most transformative K-12 policy in our nation’s history” remains an airplane without wings.

In fact, Petrilli says, DeVos has been something of a drag on the school choice movement. “Charter schools used to have strong bipartisan support,” Petrilli says, but DeVos and Trump have been such polarizing figures that many Democrats abandoned the cause. “Now, Joe Biden has come in with the most anti-charter school platform since charter schools were invented 25 years ago. And I think that some of that has to be laid at the feet of Betsy DeVos.”
