Lawyers In Trump White House To Appear Before 1/6 Grand Jury

WASHINGTON The White House counsel under former President Donald Trump and his top deputy are set to appear Friday before a federal grand jury investigating efforts to undo the 2020 presidential election, a person familiar with the matter said Thursday.

Pat Cipollone was the top White House lawyer at the end of the Trump administration as Trump and outside allies pressed for ways to overturn the results of the election, culminating in the Jan. 6, 2021, riot at the U.S. Capitol.

Cipollone vigorously resisted efforts to undo the election and has said he did not believe there was sufficient fraud to have affected the outcome of the race won by Democrat Joe Biden.

He and Patrick Philbin, a deputy White House counsel also set to appear before the grand jury, have already cooperated with a separate House committee probe investigating the Jan. 6 attack and attempts to subvert the election.

The person who confirmed their appearance before the grand jury was not authorized to discuss the matter and spoke to The Associated Press on the condition of anonymity. ABC News was first to report the appearance. Spokespeople for the Justice Department declined to comment.

The scheduled grand jury appearances underscore how Justice Department officials examining schemes to overturn the presidential contest have been seeking the cooperation of senior White House officials and advisers who opposed those efforts.

President Joe Biden warned Thursday night that equality and democracy are under assault in the U.S. as he sounded an alarm about his predecessor, Donald Trump, and MAGA Republican adherents, labeling them an extremist threat to the nation and its future.

Aiming to reframe the November elections as part of a battle for the nations soul the work of my presidency Biden used his prime-time speech at Independence Hall in Philadelphia to argue that Trump and the Make America Great Again allies who now lead the Republican Party are a menace to the nations system of government, its standing abroad and its citizens way of life.

The Republicans renominated Trump for president, and Joe Biden, Obamas former vice-president, emerged from a wide field to be the Democratic nominee. Biden selected as his running mate Senator Kamala Harris of California, whose mother was from India and whose father was African- American.

As the election approached, COVID-19, a virus that originated in China, began infecting an increasing number of Americans and taking an increasing number of lives. Trump downplayed the deaths, claiming that the virus would disappear. He refused to wear face masks and did not insist that supporters do so at his campaign rallies even after he was briefly hospitalized with the disease.

Largely as a result of the pandemic, many states liberalized voting so that more people could cast mail-in ballots rather than physically go to a polling place. Trump charged that this would lead to voting fraud.

Many states decided to count mail-in ballots after they finished counting votes cast in person on election day. Trump, who had urged his own supporters to vote in person on election day, was shown with an early lead as vote-counting began. This lead evaporated as more votes were counted. Although the election was held on Tuesday, it was not until that Friday that news outlets were comfortable in reporting that Biden had won both the popular vote and the majority of the Electoral College.

Efforts To Obstruct Justice

This is likely to be the crucial difference, possibly alongside No. 1, if Trump is ever charged.

As mentioned earlier, Trump resisted returning these documents. He didnt return them even after one of his attorneys agreed last year that they should be returned. His attorney also signed a document in June stating that all documents marked as classified had been returned, according to the Times. And the government cited the likelihood that it would find evidence of obstruction to obtain the search warrant.

Precisely what the government believes might rise to the level of obstruction, well have to see.

As for Clinton, she testified to Congress about her private email server as part of the Benghazi hearings. She sat with the FBI in a voluntary interview for more than three hours. She also turned over tens of thousands of emails.

Her critics, including Trump, have long suggested that she engaged in a coverup by virtue of her and her team deleting many other emails and destroying phones. Clearly Intentional And Willful Mishandling Of Classified Information

This was the portion of Comeys decision that was most disputed in Clintons case.

The applicable law, the Espionage Act, states that it is a crime to remove national defense information from its proper place of custody through gross negligence. But Comey indicated that Clintons alleged misconduct had to be clearly intentional and willful to bring a prosecution a standard many critics at the time complained was higher than gross negligence because it required intent. Comey even said in the same news conference that Clinton had been extremely careless, which sounds a lot like grossly negligent.

Comey said Clinton and others should have known better than to potentially expose this information on a private server, but we did not find clear evidence that Secretary Clinton or her colleagues intended to violate laws governing the handling of classified information.

He said at a hearing two days later that there was insufficient proof that Clinton intended to obscure her emails. Our best information is that she set it up as a matter of convenience, he said, echoing Clintons own justification.
