In its thorough opinion, the D.C. Circuit rejected Trumps claim that delaying disclosure of the records to allow further litigation wouldnt do harm, instead finding that the legislature is proceeding with urgency to prevent violent attacks on the federal government and disruptions to the peaceful transfer of power. In doing so, the court relied on the 1974 Supreme Court precedent requiring President Richard M. Nixon to produce secret White House tape recordings despite Nixons claim of executive privilege.
Even if court appeals do result in the process being dragged out past November 2022 and a change of House party control, this run-out-the-clock ploy still wont affect the working of the Justice Department and its prosecution of Bannon, and the expected one of Meadows, for criminal contempt of Congress. A Republican-controlled House of Representatives could ultimately dismantle the Jan. 6 investigation, but that doesnt prevent the criminal prosecution from proceeding and a jury from deciding whether these defendants are guilty.
At the same time, the House select committee has a long-neglected but powerful constitutional tool it can use to compel witnesses to honor its subpoenas. Congress doesnt need the Justice Department or the courts to hold the witness in the custody of the Capitol Police to obtain sworn testimony it can do so itself.
In Reversal Former Trump Chief Of Staff Mark Meadows To Cooperate With Jan 6 Select Committee

Rep. Bennie Thompson, D-Miss., the chairman of the panel, said in a statement that Meadows has been “engaging” with the panel through his lawyer, providing records to the committee “and will soon appear for an initial deposition.”
Meadows was subpoenaed by the committee in late September for records and testimony regarding his and Trump’s activities before and during the Capitol riot.
Mr. Meadows has been engaging with the Select Committee through his attorney. He has produced records to the committee and will soon appear for an initial deposition,” the committee said in a statement Tuesday. “The Select Committee expects all witnesses, including Mr. Meadows, to provide all information requested and that the Select Committee is lawfully entitled to receive. The committee will continue to assess his degree of compliance with our subpoena after the deposition.
His lawyer initially said Meadows wouldn’t cooperate with the committee because of Trump’s plans to assert executive privilege, an argument dismissed by the committee, whose members will vote this week to hold former DOJ official Jeffrey Clark in contempt of Congress for ignoring the panel’s subpoenas.
Rep. Adam Schiff, D-Calif., a member of the panel, said over the weekend that the committee would decide whether to hold Meadows in contempt this week.

WASHINGTON Two days after Christmas last year, Richard P. Donoghue, a top Justice Department official in the waning days of the Trump administration, saw an unknown number appear on his phone.
Mr. Donoghue had spent weeks fielding calls, emails and in-person requests from President Donald J. Trump and his allies, all of whom asked the Justice Department to declare, falsely, that the election was corrupt. The lame-duck president had surrounded himself with a crew of unscrupulous lawyers, conspiracy theorists, even the chief executive of MyPillow and they were stoking his election lies.
Mr. Trump had been handing out Mr. Donoghues cellphone number so that people could pass on rumors of election fraud. Who could be calling him now?
The message was delivered by an obscure lawmaker who was doing Mr. Trumps bidding. Justice Department officials viewed it as outrageous political pressure from a White House that had become consumed by conspiracy theories.

WASHINGTON The House on Tuesday debated recommending criminal contempt charges against former White House Chief of Staff Mark Meadows after he ceased cooperating with the bipartisan select committee investigating the Capitol insurrection of Jan. 6.
If approved, it would be the first time the House voted to hold a former member in contempt since the 1830s, according to the chambers records. But its the second time the special committee has sought to punish a witness for defying a subpoena.

Its the latest show of force by the Jan. 6 panel, which is leaving no angle unexplored and no subpoena unanswered as it investigates the worst attack on the Capitol in more than 200 years. Lawmakers on the panel are determined to get answers quickly, and in doing so reassert the congressional authority that eroded while former President Donald Trump was in office.
Republicans on Tuesday called the action against Meadows a distraction from the Houses work, with one member calling it evil and un-American.

Former Trump Chief Of Staff Mark Meadows Cooperating With Jan 6 Probe
The chair of the House committee investigating the Jan. 6 riot at the U.S. Capitol said Tuesday that former White House chief of staff has begun cooperating with their probe.
Mr. Meadows has been engaging with the select committee through his attorney,” Rep. Bennie Thompson, D-Miss., said in a statement. “He has produced records to the committee and will soon appear for an initial deposition.”
The committee had been considering pressing ahead with a criminal contempt of Congress referral against Meadows after he failed to show up to answer questions under oath earlier this month.
Meadows’ attorney, George Terwilliger, said at the time that his client remains under the instructions of former President Trump to respect long-standing principles of executive privilege. It now appears the courts will have to resolve this conflict.
Terwilliger said Tuesday that “we continue to work with the select committee and its staff to see if we can reach an accommodation that does not require Mr. Meadows to waive executive privilege or to forfeit the long-standing position that senior White House aides cannot be compelled to testify before Congress.”
“We appreciate the select committees openness to receiving voluntary responses on nonprivileged topics, he added.
While Meadows’ cooperation staved off a legal showdown for the moment, Thompson left the door open to civil or other action in his statement Tuesday.
Who Will Be Trumps Next Chief Of Staff It Doesnt Really Matter
Trump functions as his own boss, and his family still has a lot of influence in the White House, hampering a future chief of staffs power.
President Donald Trump is in the market for a new chief of staff, but his management style, reluctance to change, and relationship with his past two top aides suggest it might not ultimately matter much whom he selects.
Unless Trump significantly changes how he views the role a once-coveted job in Washington that now appears to have few takers and actually empowers a chief of staff, those close to the administration admit that his choice wont change much for the White House.
I doubt it matters who he selects, said a former White House official. The results will always be the same. The only thing that might be different is the length of the honeymoon afforded to the new chief of staff.
John Kelly, Trumps second chief of staff, is due to leave the White House in the coming weeks, the president announced this weekend. Trump had assumed for weeks that Vice President Mike Pences top aide, Nick Ayers, would accept the job.
Eventually, Ayers announced this weekend that he, like Kelly, would be leaving the administration at the end of the year. Trump is now starting from scratch to find a replacement, but several sources said continued power clashes in his administration would make it hard for the chief of staff to impose any real authority.

Us House To Vote On Contempt Charge Against Ex
WASHINGTON – The U.S. House of Representatives is set to vote on Tuesday on whether to seek criminal contempt of Congress charges against Mark Meadows, Donald Trump’s chief of staff, for refusing to cooperate with a congressional probe of the deadly Jan. 6 Capitol attack.
The seven Democrats and two Republicans on the Select Committee investigating the attack voted unanimously on Monday evening to recommend that the full House approve its report making the case for a contempt of Congress charge against Meadows, who served in the House before joining the Republican president’s administration.
Republican Representative Liz Cheney, the panel’s vice chair, read out panicked texts from Republicans and others pleading with Meadows on Jan. 6 to urge Trump to appear publicly and call off his followers. The texts surfaced during the Select Committee’s investigation.
“He’s got to condemn this shit ASAP. We need an Oval Office address,” Trump’s son Donald Jr. said in one text. In other texts, conservative media hosts made similar private pleas to Meadows – before playing down the violence of the attack on the air.
“The American people deserve to know all of the steps that Donald Trump and those around him and that his campaign were taking in an effort to change the results of the election,” Cheney said.
The charge carries up to a year in prison.

Trump employed similar tactics as a private citizen when sued for allegedly defrauding enrollees in Trump University and for mismanaging the Trump Foundation. Then when president, Trump sued to block his accountants from disclosing his tax records in response to a Manhattan grand jury subpoena. Trump was able to stall the inevitable for a while but eventually settled these civil suits and lost in the U.S. Supreme Court, which rejected his claim to be immune from being investigated while president.
In the case of the Jan. 6 investigation, Trumps own lawsuit seeking to block the National Archives from turning over White House documents to the committee promptly cratered. Not only was Trumps claim of executive privilege rejected by the U.S. Court of Appeals for the District of Columbia Circuit on Thursday, but the court system acted at warp speed, by litigation standards, to do so.
Kelly Isnt Used To Domestic Policy Or The Open Debate That Comes With It
Kelly was one of a triumvirate of generals named by Trump to key Cabinet-level positions before his inauguration: Gen. James Mattis was named secretary of defense, and Gen. Mike Flynn was named national security adviser .
But while Mattis and Flynn had experience working in defense and intelligence, Kelly didnt have experience with domestic national security policy. Hed worked extensively in Central America as head of US Southern Command, but he knew little about domestic immigration policy not to mention the grab-bag of other things with which DHS is tasked.
More importantly, he didnt have experience with the open debate and criticism that domestic policy engenders. While the government often gets some deference from the press, Congress, and the public on national-security issues, that deference isnt absolute especially 16 years after 9/11. And that criticism sometimes extends to the people carrying out the policy.
The saying Politics stops at the waters edge still describes a powerful norm: Soldiers arent criticized for carrying out the policies of their governments, and it takes egregious abuses of rules of engagement for individual soldiers to be shamed. But that doesnt apply to people within the US even law enforcement officers.
